Got hit today. Minding my own business. Stationary at a traffic light in middle lane. Huge truck inches forward and right to swing wife to make a left. Hits me. Guy was super nice and apologetic. Officer declared him at fault as I was in my lane and stationary. I just hope this doesn't total me. It's a 2001 with 170k miles. Virginia law is 75% value is salvaged. I literally just got this thing aligned, and was driving to a garage to get help with a stuck bolt to mount my race seat.

I know that this isn’t always the case, but the one car I totaled I got more from insurance than I paid for the car. Paid 12,0 00 for my 2001 MP5, got a check for $14,500 from the insurance company.

As a fellow NB owner, a 2001 with that many miles isn’t worth much anyways. I’d just leave it the way it is. Or have a Paintless Dent Removal guy take a look, they can sometimes work miracles .

there are a few PDR guys that can do well with that. At worst I’d have them push on it until taking it to a body shop to have filled and primed before having it wrapped . Replacing the quarter panel is not necessary and I’d avoid it at this point, plus it’s easier to avoid having it totaled if you ask them to repair, not replace it, and no blend panels. Keeping the estimate down could get it in the shop.

VA salvage law 75% only applies if under 10 years of age, or worth more than $10,000.
Insurance can (and will probably want to) go to 100% of ACV before totalling your car.

Rear quarter damage of any sort will definitely total any miata unfortunately. I did have them replaced on my car (rust and accident damage worse than this) but it was at the cost of nearly 100 hours of labor doing all sorts of welding. Granted both sides and the rockers were also replaced, but its very much a custom weld in job. The panels are cheap (~ $200 per panel on rock auto ) but its the labor hours that will kill you.
Unfortunate, but if the alignment isnt screwed up or anything is bent in the back you can certainly just drive it as is.

I don’t have a link to the statute, but I’ve been writing estimates and managing collision repair shops in VA for close to 15 years, and it's something that comes into play monthly for me.
ACV (actual cash value) is determined by a valuing tool within ADP/Mitchell/CCC software (varies from carrier to carrier as to which is used), but NADA and KBB can usually give a pretty accurate idea of value.

Shit. My insurance is going through them so CE I don't carry collision on that car. I want something done to fix it, even if it's dent removal. I'd love to pocket some money for this too, if they pay money to fix it right that I take some to dent removal, and buy go fast parts with the rest. But I gotta deal with a rebuilt title inspection, and I got autocross next weekend. Might have to drag my feet a bit to not get my registration revoked

Dent removal (aside from some PDR magic) would definitely include extensive body filler to get it right. I think PDR could definitely do something to get it “better” but those panels arent usually that fixable, especially if it’s beyond a small dimple. Even if totaled, the payout should be nice and assuming you werent trying to sell the car, it would be worth using the money to do some sort of PDR “fix” and pocket the rest.
Also, d id the wheel get pushed at all also? Does it drive straight? Make any noise while driving?

Thsnks. I’m been trying to pull info off the dmv website and didn’t see that. If it does get salvaged, do you know what needs to be fixed to get a rebuilt title? Since it's just cosmetic body work, does it matter? It just passed safety inspection a few months ago, and emmisions literally 5 minutes before

I’ve never seen it in print anywhere, but I’ve had numerous major carriers (NWide, SFarm, Erie, Allstate, USAA, Geico, Farmers, etc) go by it.
It might not even total. I hate writing estimates from photos, but a good shop will probably want to detrim and blend the door and possibly the trunk (buckle looks to run high in the quarter) , and detrim (convertible top belt, taillamp, and rear bumper cover) , pull and repair the quarter panel. You’d be surprised what a couple hours of pins/tabs, pulls and hammer strikes can do to relax that buckle. Polish that wheel (or throw a used/reconditioned wheel at it) and give it a 4 wheel alignment.
Pending labor rates, you’re probably in the $1800-2000 neighborhood for a repair estimate, which may not kill the car.

I hope you’re right. The good news is the wheels and clea r coa st are shot. No need to fix wheel or blend paint. But as wrong wheel drive pointed out, that panel is welded in. I'm stuck where I don't need it perfect, but want them to pay for it, but don't want it totalled.

A good body shop should be able to provide a fairly accurate estimate of the repair cost, and that number is what the insurance will use to determine a payout . Since the other driver was 100% at fault, you should be able to go after their insurance for the full cost of the repairs. I can’t imagine that insurance company can force you to total if you don’t want to— I think that decision only comes into play if your insurance is paying out the claim.
However, if your insurance totals, take the check and buy back the car . Fix anything safety related (based on the photo it doesn’t appear there is anything of concern there) so you can get a rebuilt title, and then decide what cosmetic issues you want to deal with (or not).
It’s not a high value car, so a rebuilt title isn’t going to be a massive problem for resale value. If you ever think you are going to want to sell the car one day, take a ton of photos before and after repairs so you can put a future buyer at ease about the rebuilt status.

Problem with the buyback, if it comes to that, is apparently VA wants all damage fixed, even cosmetic, to get a rebuilt title. Then, it apparently takes 4-8 weeks to get said title. Goodbye summer driving and autocross season.
